CLIENT PORTAL TERMS

Portal Access & Use Agreement - Effective Date: 3 March 2025

1. Purpose

This Agreement outlines the conditions under which authorised users (“you”, “your”) may access and use the Tika EQ Portal (“Portal”), a secure online platform for sharing project-specific materials, updates, and consultation information.

By accessing the Portal, you agree to comply with these terms and maintain cultural, ethical, and data integrity standards.

2. Authorised Access

Access to the Portal is limited to individuals invited by Tika EQ in connection with a specific project, consultation, or partnership.

You must:

- Keep login credentials confidential;

- Not share access with unauthorised individuals;

- Notify Tika EQ immediately of any suspected unauthorised access or security breach.

3. Use of Information

You may access and use materials on the Portal solely for the purposes of your authorised engagement.

You must not:

- Copy, download, or share materials outside the agreed project scope;

- Alter or misuse content, including Indigenous Cultural and Intellectual Property (ICIP);

- Use Portal materials for personal or commercial purposes unrelated to Tika EQ activities.

4. Confidentiality

All materials shared via the Portal, including cultural information, community insights, research, or project documentation, are considered confidential.

You agree to:

- Maintain confidentiality of all shared information;

- Not disclose or reproduce content without written consent from Tika EQ or relevant community custodians.

5. Indigenous Cultural and Intellectual Property (ICIP)

Tika EQ recognises the custodianship and sovereignty of Indigenous Peoples over their ICIP.

By using the Portal, you agree to:

- Engage with ICIP materials respectfully and only for authorised project purposes;

- Seek and uphold cultural consent for any future use or reference;

- Attribute ICIP appropriately where authorised to do so.

Tika EQ will ensure ICIP is handled in accordance with cultural governance and community direction.

6. Data Protection

Tika EQ applies technical and organisational safeguards to protect personal and cultural data stored on the Portal.

You agree to take reasonable precautions (e.g. using secure devices and networks) to protect any downloaded or viewed materials.

7. Termination of Access

Tika EQ may suspend or revoke Portal access at any time, including where:

- Your role in the project or consultation has concluded;

- You breach confidentiality, ICIP, or security obligations; or

- Continued access poses a cultural or data risk.

Upon termination, you must delete any downloaded materials and cease using Portal content.

8. Compliance and Cultural Conduct

You agree to uphold:

- Cultural safety and respect in all Portal interactions;

- Community protocols and guidance from Traditional Owners or cultural authorities;

- Ethical, trauma-informed, and inclusive engagement practices.

9. Liability

Tika EQ is not liable for any data loss, unauthorised access, or damages arising from user misconduct or technical issues beyond its control.

10. Acknowledgement and Acceptance

By logging into the Portal, you confirm that you:

- Have read and understood this Agreement;

- Agree to comply with all obligations outlined above; and

- Acknowledge your responsibility to handle information and ICIP ethically and lawfully.
